Terms of Service

These terms govern your use of Kotoba, operated by DIGITALIS (“we”). By creating an account you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.
The service
Kotoba connects to an Instagram professional account you control and provides an inbox, comment management, publishing and scheduling, analytics, and AI-assisted translation and drafting. We add and change features over time. If we remove something you depend on, we will tell you first.
Your account
You are responsible for what happens under your account and for keeping your credentials to yourself. Tell us promptly if you believe someone else has access. One person or organisation per account; do not resell access without our agreement.
Your Instagram connection
You authorise Kotoba to act on your Instagram account within the permissions you grant, and you confirm you have the right to do so for the account you connect. You can revoke that authorisation at any time, from within Kotoba or from Instagram's own settings. Your use of Instagram remains subject to Meta's terms, and nothing here overrides them.
Acceptable use
Kotoba exists to help you have real conversations with people who follow you. Do not use it to send unsolicited bulk messages, to harass, threaten, defame or impersonate anyone, to distribute malware or illegal content, to scrape or resell other people's data, or to evade Instagram's rate limits, spam controls or platform policies. Do not use it to automate deceptive engagement. We may suspend an account that does these things, and we will do so without much hesitation where someone is being harmed.
AI-assisted output
Translations, drafts and tone assessments are suggestions produced by a language model. They can be wrong, and they can be subtly wrong in a language you do not read. Nothing is sent on your behalf without your action, and you are responsible for what you choose to send or publish. Do not rely on Kotoba's output for legal, medical, financial or safety-critical decisions.
Trial, plans and payment
New accounts start with a 14-day trial that needs no card. After that, continued use of paid features requires a subscription at the price shown when you subscribe. Fees are billed in advance and are not refundable except where the law requires it or where we have plainly failed to deliver. You may cancel at any time, effective at the end of the period you have paid for. We will give at least 30 days' notice by email before any price increase affects you.
Your content
Your messages, posts and media remain yours. You grant us only the permission needed to run the service for you — to store, process, translate and transmit that content as the features you use require. We claim no other rights over it and we do not use it to train models.
Availability and warranties
We work to keep Kotoba running but do not promise uninterrupted or error-free service. Kotoba depends on Instagram's API, which Meta may change, restrict or withdraw at any time, and on other third-party services; interruptions from those are outside our control. To the fullest extent the law allows, the service is provided “as is” and without warranties of any kind.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, nor for lost profits, lost data or lost opportunities. Our total liability arising from the service is limited to the amount you paid us in the twelve months before the claim arose. Nothing here limits liability that cannot lawfully be limited.
Termination
You may stop using Kotoba and delete your account at any time. We may suspend or terminate an account that breaches these terms, that we are legally required to act against, or that puts the service or other users at risk. If we terminate an account that has not breached anything, we will refund the unused portion of any prepaid fee.
Changes
We may update these terms. For material changes we will notify account holders by email at least 30 days before they take effect, and continuing to use Kotoba after that means you accept them.
Governing law
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules, and the courts located there have exclusive jurisdiction — except that either party may seek injunctive relief in any competent court. If you are a consumer, this does not deprive you of protections you have under the mandatory law of your country of residence.
